SECTION 9 - Warranties and liability of Mon Panier Latin
The Site is provided by Mon Panier Latin without any warranty. You must assume the risks associated with the use of the Internet.
Although Mon Panier Latin strives to ensure the accuracy of the information on the Site or in any other document, we can not accept any responsibility if, despite our efforts, this is not the case. If Mon Panier Latin is informed of inaccuracies in the information contained on the Site, we will endeavour to correct them as soon as we can.
In particular, we do not accept any liability for the following:

- Adequacy, unreliability, or inaccuracy of the site and its content
- Inadequacy of the site to meet your needs

We guarantee that the products will be of satisfactory quality and therefore if an item proves to be faulty, a replacement item or a discount may be offered on your next purchase at our discretion. Please contact us within 24 hours of delivery with any complaints or queries regarding the products delivered and we will arrange for any of the above.
The warranty provided by the above paragraph does not apply to defects or failures which have been caused by your misuse and/or neglect of the products or by accidents caused while the products are in your possession.
We shall not be liable to you by way of representation (except fraudulent), by operation of law, or by virtue of any express or implied term of the contract for :
- any loss not foreseeable by you and us at the time of making contact for the supply and purchase of the products, arising in connection with the supply of the products and associated services or their use by you;
- any loss that is not caused by a failure on our part; or
- commercial or operating losses (including, but not limited to, loss of profits, goodwill, reputation, and business).
Subject to the provisions of Section 9, our total liability under the contract for the supply and purchase of the Goods shall not exceed the purchase price of the Goods in question.
Nothing in these terms and conditions shall mean that our liability to you for death or personal injury resulting from our negligence or that of our employees, agents, or sub-contractors is limited.
We shall not be liable for any delay or failure to perform our obligations due to events beyond our reasonable control such as, but not limited to, fire, flood, weather, natural disaster, strike, industrial dispute, riot, civil commotion, accident, disruption of power supply, breakdown of equipment or suppliers, traffic problems, terrorism or war.
Our acceptance of an order takes place at the time you place the order, at which time the purchase contract will be concluded and you will be invoiced for your order.

SECTION 11 - Third Party Websites

These terms and conditions shall be governed by and construed in accordance with the laws of the United Kingdom and any disputes shall be decided solely by the courts of the United Kingdom.
SECTION 13 - International Use
Mon Panier Latin makes no representation that materials on the site are appropriate or available for use outside the United Kingdom.
SECTION 14 - Miscellaneous
You may not assign, sublicense or otherwise transfer your rights under these terms and conditions.
If you breach these terms and conditions and Mon Panier Latin ignores them, Mon Panier Latin will still be able to exercise its rights and remedies at a later date or in any other situation where you breach the terms and conditions.
Mon Panier Latin will not be liable for any breach of these terms and conditions caused by circumstances beyond its control.
A person who is not a party to these terms and conditions has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these terms and conditions, but this does not affect any rights or remedies of a third party that exist or are available outside of that Act.
If any of these terms and conditions are determined to be illegal, invalid, or unenforceable, in whole or in part, by any court or competent authority, this shall not affect the validity of the remaining terms and conditions which shall continue to be valid and enforceable to the fullest extent permitted by law.

My Panier Latin - Terms and Conditions of Sale of Products
Please read these terms and conditions of sale of products carefully as they relate to your rights and responsibilities under the law and set out the terms and conditions on which Mon Panier Latin makes products available to you ("Terms and Conditions of Sale").
Overview
These Product Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom and any disputes shall be decided solely by the UK courts.
If any of these Product Terms and Conditions are determined to be illegal, invalid or unenforceable, in whole or in part, by a court of competent jurisdiction, this will not affect the validity of the remaining Product Terms and Conditions which shall continue to be valid and enforceable to the fullest extent permitted by law.
SECTION A - Acceptance
The purchase contract is concluded upon ordering and paying for the goods and delivery. You will be invoiced for the goods and delivery at the time you place your order. There will be no contract between you and us until you have purchased the goods. Until payment is made we may refuse to supply the goods to you without giving any reason. At the time the goods and delivery are paid for (and not before), a contract will be formed between you and My Latin Basket.
SECTION B - Prices
Mon Panier Latin sells its products online in pounds sterling (GBP).
The selling prices of the Products are those in effect on the day of the order.
In the case of a promotional price, Mon Panier Latin agrees to apply this price to all orders placed during the advertising period of the promotion.
All prices, unless otherwise stated, are inclusive of VAT (at the rate in force at the time of acceptance of the order). We reserve the right to change prices without notice.
Additional carriage charges will apply for Northern Ireland, the Highlands, and the Islands. For orders outside the UK, please contact us and we will endeavour to find a solution for shipping your goods.
SECTION C - Payment
Mon Panier Latin Cart offers the following payment options:

Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Payment authorisation must be given at the time of ordering.
You must ensure that Mon Panier Latin has a valid credit or debit card bearing the Maestro, Mastercard, Visa, Visa Electron, Delta, or Switch symbol. You must inform us immediately of any changes to these details. You can change your payment details by updating them in the "My Account" section of the website or by calling or emailing us at bonjour@monpanierlatin.co.uk. Without prejudice to the paragraph below, we accept no responsibility for the security of the Card if the Card details are sent to us by email, as email is inherently insecure.
Your credit card and payment details will be stored on our system; we make every effort to ensure the security of these details. You can find more information on data security in our Privacy Policy. Your card will automatically be charged for the goods you have ordered, prior to delivery. We will submit our request for payment to your bank within 72 hours of delivery, and normally within 24 hours. However, we cannot accept any responsibility for the time taken by the bank to process the payment.
We reserve the right to suspend deliveries and/or terminate our agreement with you if your card issuer refuses to authorise payment or if we have reason to believe that payment will be refused. You agree to indemnify us in full for all reasonable costs and expenses (including reasonable legal costs and expenses) which we may incur in obtaining payments owed to us by you and which you have failed to make in accordance with your agreement with us as set out in these terms and conditions.
If a payment has been rejected by your bank, you will not be able to change, cancel or complete your orders via our website. You must contact us to arrange payment and wait for the payment to be made before you can change your order again via the website. However, you can change your order by calling or emailing us (contact details are on the website), during our office hours and within the order timescale.
Our liability to you in relation to any order will not exceed the total price charged for the items concerned.
We only accept orders from web browsers that allow communication via Secure Socket Layer (SSL) technology. This means that you cannot inadvertently place an order through an unsecured connection. We suggest that you upgrade to the latest version of your browser to maintain security.
SECTION D - Payment Security
Mon Panier Latin guarantees the implementation of security measures to ensure the security of payments on its site.
Mon Panier Latin reserves the right to ask the customer for any additional evidence to complete the order.
SECTION E - Availability
The products are offered and delivered within the limits of available stocks. The catalog of Mon Panier Latin Products is subject to constant change.
In the event that an ordered product is out of stock, we will refund the price of the missing product within thirty (30) days in the form of a credit note. You are entitled to refuse the proposed credit. In this case, once notified, we will make the refund by the same method of payment as the original payment.

SECTION F - Delivery method
Delivery will be made to the name and address you provide on the completed order form. We are not responsible for the non-receipt of goods if the address is incorrect or incomplete.
Packages are shipped to you by ParcelForce, DPD, Yodel, or a designated carrier.
Free shipping on orders over £65 within the UK (outside Northern Ireland, the Highlands, and Islands, shipping charges apply).

SECTION G - Delivery times
Every effort is made to ensure that goods are received by the buyer within 48 to 72 hours of the order being dispatched.
Mon Panier Latin makes every effort to meet the delivery times of products ordered. However, we can not be held responsible in the event that these deadlines could not be met when the delivery is entrusted to external providers. The latter will automatically inform you by any means such as email, SMS, tracking service, or by phone in case of delay.
You can call Mon Panier Latin to report the delay by contacting Customer Service to agree on the best solution.
SECTION H - Delivery of Goods and Inspection by You
Please note that due to the perishable nature of our goods, we cannot accept cancellations or changes to orders less than 24 hours before the delivery date.
We will deliver to the address you provided when you created your account or updated your account address. It is your responsibility to make arrangements to receive your delivery and to give us the appropriate instructions. If your delivery is stolen from your door or damaged on site, we cannot accept any responsibility. Any change of address must be made 72 hours before the order date.
We endeavour to keep the same delivery day, but reserve the right to change it temporarily or permanently and will inform you of this.
If we are unable to deliver to you or have to deliver late, for reasons beyond our control, for example, adverse weather conditions, strikes, vehicle breakdown, traffic congestion, or supplier failure, we cannot accept responsibility for any inconvenience or loss this causes.
You must inspect the items immediately after delivery and inform us promptly if you find any defects or errors, by calling or emailing us within 24 hours of delivery at bonjour@monpanierlatin.co.uk . Our liability is limited to the refund or replacement of the item, at our discretion.
SECTION I - Non-delivery
If the goods are not available at the time your order is prepared, you will be informed as soon as possible or you will receive a replacement item.
SECTION J - Returns
In the event that you are not completely satisfied with your purchase, the following conditions apply:
- Firstly, phone Mon Panier Latin with the problem on 020 8159 5140 or email us at bonjour@monpanierlatin.co.uk. If your request is successful, obtain a return number and include it on all return packages.
- The package must be clearly addressed to Mon Panier Latin. Returned goods must be received no later than 14 days after the delivery date (excluding perishable goods/fresh food)
- All items must be returned in their original packaging and must not be opened.
We cannot accept any goods:
- which have been damaged due to mishandling or abuse, and/or
- which have been partially opened, partially used, or whose seals or labels have been removed or altered.
- which are perishable/fresh food.
If you fail to comply with any of the above, credit or refund will not be given. All goods are returned under your responsibility unless incorrect selection and shipment have been made by Mon Panier Latin. We suggest that you request a postage certificate and adequate insurance.
SECTION K - Cancellation Rights
Mon Panier Latin may suspend or cancel any accepted order or your registration immediately at our reasonable discretion or if you fail to comply with any of your obligations under these terms and conditions.
You may cancel your registration at any time by notifying us by email at bonjour@monpanierlatin.co.uk . If you do so, you must immediately stop using the Mon Panier Latin services.
The suspension or cancellation of your registration will not affect your and/or our rights or liabilities accrued to the date of suspension or cancellation or any orders submitted by you prior to our receipt of notice of your cancellation, and you will continue to be bound by such orders.
SECTION L - Product Specification
Some products or services may have limited quantities and cannot be returned or exchanged, please contact us if this is the case.
We endeavour to display as accurately as possible the colours and images of our products that appear in the shop. We cannot guarantee that the display of any colour on your computer screen will be accurate.
The list and characteristics of the products offered on the site My Latin Basket are subject to change and adaptation at any time to better meet customer expectations.
The photographs illustrating the products sold on Mon Panier Latin are merely suggestions for presentation. The products being in constant evolution, the manufacturers can modify without notice the packaging of the products, the technical composition and the characteristics of the product references. The possible variations between these photographs and compositions, and the products do not engage the responsibility of Mon Panier Latin. Please refer to the product labeling before consumption.
We reserve the right, but are not obliged, to restrict sales of our products or services to any person or geographical area. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services we offer. All product descriptions or product prices are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time. Any offer of products or services made on this site is void where prohibited.
